General Terms & Conditions

 

Parts:

The General Terms and Conditions, hereinafter as “GTC” apply to:

EmiStores websites (www.emistores.ch, www.emi-stores.com, www.emi-stores.ch) hereinafter as “Emistores” on one side

and

The consumers that accept the “GTC and the use of EmiStores’ sites, hereinafter denominate as “Customer”.

Customers in the sense of these GTC, is any natural person who enters into a legal transaction for purposes of buying on EmiStores. As customer must warrant to be legally capable, over 18 years old and Suisse or Lichtenstein resident.

 

Scope:

This GTC will rule all the relation between EmiStores and the Customer. By using, placing and completing an order you have agreed on this GTC. If the customer has not agreed on this GTC ,  the Customer will be rejected automatically and will not able to progress on the purchase order.

 

EmiStores:

EmiStores is an independent professional activity from Emilia Abbruzzese (Steinhausen).

Service Area:

EmiStores service is provided only in Switzerland and Lichtenstein; orders out of this area cannot be accept.

 

Changes:
EmiStores has the right to make changes on prices, descriptions, pictures as well changes on the GTC. All changes will come into force once they are announced or publish on their website and will apply to all agreements for the acquisition of merchandises on EmiStores from that date.

 

Prices:

The prices include Vat, transportation and bank / credit card / PayPal  fees, . Prices can change without notice.

 

Payment ans Security:

Once decide to proceed with the purchase of the goods, a secure mode will automatically be activated. All payments are secured by “SSL Secure Shopping”, so they guarantee that the data is encrypted so is safe and secure; in this mode a padlock visible in the bottom left corner of the page will be seen.

 

The customer has 3 payment options available:  

Off-line or Bank transfer, b) PayPal (PayPal direct or Credit card through PayPal) and c) Credit card.

 

 

Off-line purchase or Bank Transfer:

If the customer has selected Off-line purchase, will be directed to a secure page and a fill-form. This method is only for pre-payment through bank transfer; so to proceed, the customer must transfer the total amount without any deduction to EmiStores bank account. The easiest way to do it is by online banking. To select this payment method the customer must select “Zur Kasse” and follow the instructions to the end, during this method, the customer should provide all the information needed to effectively complete and pay for the order.

Please de aware of:

EmiStores will save the product for a maximum of 5 days; if the payment has not reach EmiStores’ account in this period, the order will be cancel.

If the payment amount doesn’t match the order amount, the customer will receive an email with the difference on pricing inviting the customer to pay the difference, if the difference on the price will not reach our account within 5 days, we will cancel the order and the desposited money will be return to the customer’s bank account.

If the payment reference do not match the order, the customer will receive a confirmation email, if is not confirm the order will be cancel and the funds will be returned to the customer’s bank account.

EmiStores will deliver the product only after payment is visible in EmiStores’ account.

 

Payment with PayPal:

If the customer has chosen PayPal as a payment method, the procedure will be instantaneous. After accepting the GTC the customer will be directed to PayPal service provider to complete the order.

PayPal, permits that the customer can pay with  PayPal account or with Credit Card. The order will PayPal will be process immediately.

 

Payment with Credit Card:

If the customer  has chosen Credit Card as a payment method, the procedure will star after accepting the GTC, then the customer will be directed to our Credit Card service provider to complete the order. The order will be process after EmiStores gets the clearance from the Credit Card service provider. This can take few hours.
Been done all the purchase at the Credit Card provider, we do not perform Credit Card checking , and all the information give will be treated according  with the data protection act.

 


Note:
Please be aware that in very seldom cases, EmiStores can have 2 orders on one last article. Been only one article, EmiStores will give priority to the first order, and if payment had come from the second customer the order will be canceled, and the money return immediately.

 

Order confirmation and acceptance of the order:

For Off-lines orders: After the customer has place the order, the customer will receive an email with all the order and bank details, so can proceed with the payment. This doesn’t mean that the order has been accepted. The order is the intention of the customer to purchase a product, and will be accepted only after full payment of the goods has been received. At that moment the customer will receive an email with the confirmation of the offer and the Invoice.

Order by PayPal is immediately and the customer will receive an email with the paid invoice of the purchase product.

Orders by Credit Card are almost immediately. The customer will receive an email with the paid invoice of the purchase product once the credit card provider clears the payment.

 

Holding of Title:

All products that have been order by the customer will remain EmiStores’ property until the full payment is complete

 

Delivery and Shipping conditions:

Delivery of goods will take place once the order and payment is complete. The good will be deliver to the given address by the customer. Please note that once the order is accepted we will not be able to modify the shipping address, unless otherwise is been agreed with EmiStores service department. 

Usually we deliver within 7 days unless is express different on the article’s description under delivery time. The delivery cost is content on the price.

After dispatching the product, the customer will receive an email with the dispatch confirmation as well as tracking code and the carrier company. Before this note, EmyStores can notify that the order has not been accepted or has been cancel; in such circumstances EmiStores will return the payment if any.  

We make every effort to convene on the delivery dates shown on EmiStores site. Once the product is handle to the carrier is out of EmiStores hand. Occasionally due to unexpected features, delays are inevitable, in such cases EmiStores shall not be held liable for any delay or failure to deliver the products in the predictable timescales if it is some how caused by situations which do not lie within our control.

If no one is presented at your delivery address to accept the order, EmiStores will inform the customer with an email encouraging the customer to contact the carrier ASAP. The carrier also will leave a note to advise the customer of the current location of the order.

Please be aware that some tines the order could be accepted by one of the customer neighbor. If this is not possible, the order will return to the carrier’s depots for further instructions that should be provided by the customer directly to the carriers company.

 

The risk that the product could be damage or loss is EmiStores responsibility until the product is deliver or until the date of the first delivery attempt.

 

Pickup from our address is not possible because of technical reasons.

 

Accurateness of content

Excluding the information as is said below, the value of the product that  the customer is paying is the price that was exposed at EmiStores at the time the order has been received, except in the case of error.

EmiStores uses constant revisions to ensure that all prices on EmiStores are accurate. Never the less errors sometimes happen. If by any chance we have discover a mistake in the price, we will contact the customer immediately to give the options of reconfirming with the actual price or canceling the order. If we are unable to contact you, the order will automatically be cancelled. If you decided to cancel the order and you have already paid, EmiStores will reimburse the full amount paid.

All sizes, measurements and dimensions are closed-approximate. EmiStores tries to display as truthfully as possible, however EmiStores cannot promise they are completely precise.

The Pictures of the goods are as close as possible to what the product looks like.

 

Liability for defects and return policy.

If you the customer think, that the goods are defective or incorrect, the requirements of the legal liability for defects/incorrect product will apply. To be able to apply to this possibility you have to contact service@emi-stores.com with in 24 hours after receiving your package. The customer should not return the package in the first instance; a return code must be provided, so contacting service@emi-stores.co is a must.  If the customer omits the normalized therein notice obligations, the goods are considered approved and accord.

After contacting service from EmiStores, we will contact you to discus the best solution and we can offer you without limitation a repairmen or replacement of the parts and if is not possible EmiStores will issue activate the exchange right of return with no deductions, including delivery charges for wrong/damage products. We will replace the total amount in vouchers good to be used in our online- store. The product must be return in the same package and with in the same circumstances as it was delivered. Damages to the product while unpacking or mounting will not apply for legal liability for defects products. EmiStores is not responsible for customer negligence. As soon as we receive the item, we will create you online voucher. Please note that we offer a exchange right of return. 

For return: After you have receive our email, with the return codes: 1. Please make sure to remove your old address label, of the original packaging. 2. Place the return form in an envelope and stick it outside this on the package. 3. Print the return label which you will received from Emistores by mail. 4. Glue a return label in a conspicuous location on the package. This label is considered Rücksendefrankierung. 5 Bring the package and the two copies of the return labels in a Parcel Shop that we will inidacte in your area. The product must be return in the same package and with in the same circumstances as it was delivered. Damages to the product while unpacking or mounting will not apply for legal liability for defects products. EmiStores is not responsible for customer negligence.

 

Guarantee:

The limitation period for the warranty claims for used products is 24 months ( unless if is said different on the product description) from the date of delivery of the product to the customer. This warranty will not apply for goods that not have been used in accordance with the description of the goods and for the purpose that the goods have been create.  This warranty will not cover intentional damage or negligence use.

EmiStores will warrant any product purchased though their websites, that be conform in all the materials, that the products have a satisfactory quality and will reasonably fit for the purpose that was create.

This warranty will cover damages witch can occur during shipping, as ell as damages that might occur during the normal use of the product.

EmiStores depending on the damage of the product can offer a replacement of the damage part, replace the product or refund the money. In any case EmiStores will be only liable for the amount paid by the customer.

To claim the warranty you must contact EmiStores customer service. EmiStores will not cover the warranty if the product has been open, modify, or repair by a service not designated by us.

 

Liability:

EmiStores is also liable for any legal reason in case of intent or gross negligence; in any case EmiStores will only cover the full paid amount provided by the customer and received by EmiStores.

 

Vouchers

The vouchers issued by EmiStores are free of charge as part of campaigns with a certain validity and cannot be purchased (the "Promotional Certificates"), can only be exchanged in EmiStores online shops, and only during the indicated period. EmiStores can excluded individual products from the coupon action, is such case, information on the coupon will be provided with the appropriate restriction of the promotional code. 

The Vouchers can only be use once prior to the conclusion of the ordering process and the expiration time. If you decide to apply for a reimbursement of the product, EmiStores will only return the paid amount and not the applied discount on the voucher.

The discount voucher cannot be applied in combination with other valid coupon codes.

The terms of the promotional coupons can be changed with out notice.

Gift cards:

The “Gift Card” is an electronic coupon issued by EmiStores that can be purchase as any other product.  The Gift Card can be use any time to purchase a product in EmiStores online shops, for the same value of the product or for a superior value, in this case (superior value product) the value of the Gift Card will be discounted and the customer is obligate to pay the difference.  EmiStores’ Gift Card can only be use once prior to the conclusion of the ordering process.

Once purchased EmiSotes’ Gift Cards for the desire value, the customer will receive an electronic code to be used on the payment process. The gift card is not transferable, and will be transmitted by email to the customer once the payment is received.  Once the Gift Card is transmitted and accepted by the customer is on his responsibility to save it and give it to the desired person. EmiStores is not responsible for misused or losses of the codes, in cases of loses the customer should inform EmiStores’ customer service as soon as possible. Please be aware that Emistores can create a new code, only if the  code has not been use.

When the code has been use, EmiStores will provide the customer with all the information about the order that used the code.

The gift card cannot be reimbursed.

 

Privacy Terms:

EmiStores respect the confidentiality and private data of all the visitors that visit EmiStores’ websites previous indicated as well as our customers. This privacy policy is regulated by the Governmental rules of the Swiss Confederation. Please see EmiStores’ privacy policies.

 

Other terms:

All contracts are concluded in the English language. All matters that might arise shall furthermore be governed by Swiss law and will be subject to the jurisdiction of the courts of Zurich.

We use our sensible actions to ensure that EmiStores’ website are free of viruses and other harmful content that might cause damage to Emistores customer’s computer; EmiStores makes no guarantees to this effect. Is responsibility of the customer to guarantee the right equipment (including without restriction up to date anti-virus software) to use websites safely.  Except where required by applicable law, EmiStores will not be responsible to any loss or damage suffered by the customer as a result of viruses or other harmful content by using EmiStores websites.

Final disposition:

By accepting the GTC, the customer agrees with the expresed Terms and Conditions. No person have any rights to enforce any term of this agreement.
